Dear Ms. Carpeneti,

I live in Iowa, which is a State in the United States like Alaska.  My question was about federal law, not state law.  In my letter, I told you what Alaska law says and asked you whether you have contacted the United States Drug Enforcement Administration (DEA) to let them know that marijuana no longer meets the finding required by Congress that anything in federal Schedule I of the Controlled Substances Act must have "no accepted medical use in treatment in the United States."  You and I both live in the United States and we are both equally affected by federal law, and, in this case, more particularly by the implementation of that law by a federal agency that isn't doing it's job.  If you don't want to answer my question, that's fine.  Just know that it was not a question about Alaska law.  I know what Alaska law says and I know what federal law says.  I'm asking why the DEA is not doing its job and whether you have contacted them on behalf of the citizens of Alaska to find out why they are not protecting the public health and safety of the people of Alaska.

Thank you!

Sincerely,
Carl Olsen

Dear Ms. Carpeneti,

Does your state have "accepted medical use" of marijuana as that term is used in 21 U.S.C. § 812(b)(1)(B)?

If yes, have you notified the United States Drug Enforcement Administration (DEA) of this fact?

If no, why not?

If you notified the DEA, what did they say?

Thank you!

Mr. Olsen,

Your e-mail to Alaska’s Attorney General Talis Colberg was forwarded to me for response.  You are concerned that the United States Drug Enforcement Administration (DEA) may not exclude marijuana from Schedule I of federally controlled substances.

For your information, in Alaska marijuana is listed as a Schedule VIA controlled substance.  AS 11.71.190.

I hope this information is helpful to you.
