Now on this 27th
day of January, 1997 the Court having been presented with the Defendant's Motion
to Reconsider and Application for Stay.
IT IS HEREBY ORDERED AS FOLLOWS,
1. The
Defendant's Motion to Reconsider is set for hearing on the 14th Day of February,
1997 at 1:30 o'clock p.m. before Hon. Jon Fister, Judge, for one hour.
2. At said
hearing, the State is ordered to present the Court with the plan of medical treatment
proposed by the Department of Corrections which would treat the Defendant's pain
as well as he has been managing his pain himself
3. The
Court's Order herein dated January 24, 1997, is stayed pending the hearing schedulcd
above.
Copies of this
Order shall be mailed to counsel of record and the Iowa Department of Corrections.
